ENVIRONMENTAL SERVICE CONTRACT
This Agreement is entered into as of this day of ,19 , by and between Mesa Oil, Inc. (here in after referred to as "Mesa Oil"), a New Mexico corporation with offices and petroleum products processing facilities located at 20 Lucero Road in Belen, New Mexico and 17300 Highway 72, Golden, Colorado, here in after referred to as "Mesa Oils Facilities"), and , a corporation which in the course of their business generate used oil, (referred to as the Generator).
WHEREAS, Mesa Oil has a facility to process, blend, or store used antifreeze to produce a product that can be shipped to distillation facilities for reuse in glycol products;
WHEREAS, Mesa Oil has a facility to process used oil filters to produce a product that can be shipped to steel mills for reuse in metal products;
WHEREAS, Mesa Oil has a facility to process, blend, and treat used grease to produce an on specification used oil fuel to be burned for energy recovery by qualified industrial burners under 40 CFR 279;
WHEREAS, Mesa Oil has a facility to process , blend, and treat used oil to produce an on specification used oil fuel to be burned for energy recovery by qualified industrial burners under 40 CFR 279;
NOW, THEREFORE, in consideration of the covenants, mutual promises, and agreement set forth herein, the parties agree as follows:
I. SERVICES
Mesa Oil shall pickup, transport and process the Generators used oil to produce an "on specification" used oil fuel to be burned for energy recovery by qualified industrial burners under 40 CFR 279 (the "Services"), all in accordance with the terms and conditions of this Agreement. Mesa Oil shall pickup the used oil within a reasonable time after the Generator requests same, provided however, Mesa Oil shall not be required to pick up quantities of less than 1000 gallons of used oil.
Mesa Oil shall pickup, transport and process the Generators used antifreeze, used oil filters, used oil, and used grease (the "Services") all in accordance with the terms and conditions of this Agreement.
Mesa Oil shall perform the Services under this Agreement in a careful, workmanlike, and lawful manner. Mesa Oil shall take all necessary and appropriate precautions as to avoid injury to persons and damage to property and natural resources.
